A 32 year-old Nigerian woman, Gift Daniel is now facing deportation from Canada after an Ottawa court overturned a decision to grant her a refugee status because of a misspelling of her name in a government birth document from Lagos.
What was unusual with the government’s appeal is immigration officials did not challenge Daniel’s claim that she was a victim of female genital mutilation and domestic abuse, but contested her credibility on the grounds that she is not who she claims to be.
"I have never seen or heard of a positive decision overturned completely by the refugee appeal division, where the pressing concern was on the identity and not on the merits of the decision," said Daniel’s lawyer, Richard Wazana.
"They did not question the forced marriage, abuse and violence."
Daniel, a hairstylist from Benin, arrived in Canada in February 2015 using a false Canadian passport under the name of Desiree Dobson and filed an asylum claim upon landing at Pearson International Airport. She was also in possession of a Social Insurance Number card, birth certificate and driver’s licence under the same name, according to federal government officials.
Daniel claimed she was forced to undergo female circumcision in 2012 and was sold by her father a year later to an older man who sexually, physically and psychologically abused her before she fled Nigeria with the help of a smuggler. The refugee board confirmed there was documented evidence of genital mutilation.
Upon her arrival in Canada, Daniel said she declared her real identity to officials as “Gift Daniel” and provided a birth document and driver’s licence issued by the Nigerian government as pro
However, a border enforcement official quickly noticed her birth document spelled her name as
“Gife” while her licence spelled it “Gift” — setting off questions by Canadian officials over her identity. She was detained at the Rexdale immigration holding centre for three months until her release on May 13, 2015, when she was granted refugee status.
Despite concerns over Daniel’s identity, refugee judge Shamshuddin Alidina, in granting her asylum, wrote the tribunal "believes, on a balance of probability, that the claimant has persuasively established her identity as Gift Daniel from Nigeria."
Daniel has insisted she only became aware of the typo after it was spotted by the border official, the different spellings of her name in her identity documents triggered the government’s challenge to the refugee appeal tribunal to overturn the asylum decision.
"Identity is clearly an important fact, so important, that if not established, there is no need to further analyze the evidence and the claim must fail," the government said in its appeal. "Absent a properly established identity, a matter of utmost importance to refugee determination, the claimant cannot be considered to be a credible witness on the material aspects of her claim for refugee protection."
In its appeal application, border enforcement officials also noted Daniel could not provide them with details on who helped her obtain the false passport she used to come to Canada and argued that her claim was “assessed on the basis of one facet of the respondent’s alleged identity: survivor of forced female genital mutilation and gendered violence. In addition to the error in her name on her birth document, they said her other ID, including two additional driver’s licences she later produced and a voter’s card, were not acceptable proof of identity.
Immigration officials argued the driver’s licences, two expired and one current that Daniel submitted bear different signatures and that one expired licence has a picture that does not look like her. The identity issue was further compounded by a new birth document Daniel later submitted with the correct spelling of her first name.
The refugee appeal division (RAD) rejected Daniel’s explanation that a friend forged her signature on her first driver’s licence because she forgot to sign it on her application.

Speaking on the reasons for her decision, she said:
“When my husband first met me, I had not had my bath, but he saw and fell in love with my natural look. My hair was due, my face looked way older, I was even tying nylon on my hair when he came to me on that fateful morning, yet he loved what he saw. So, who am I supposed to be making all that up for on my wedding day?
So, that was it. I think God just decided to crown me with early morning beauty the day I wedded.
Interestingly, the photographer and the make-up person, were insisting that I should touch up my face a little but I blatantly refused. In the process, a marriage committee member overheard us and warned that make-up is not allowed inside the Church; Christ Apostolic Church, Surulere.
Secondly, For a good start, I’m not the make-up type. I don’t even wear ear-rings or like to drop my hair. I don’t like any form of inconvenience or discomfort on my face, my neck and entire body.
It is not a church thing, it is just me and my personal decision. I can do makeup if I want to. In fact, during my engagement in April, I was so pressured to have makeup on. They convinced me that it was going to be nude. I agreed and went for it. Lo and behold, when they were done, I hated myself because I looked so unlike my usual self. I looked darker and older. The whole engagement pictures were nothing to write home about.”
On why people concluded that she is Ghanaian:
“Well, I can’t really say. My Facebook page has people around the world visiting and reading my stories. I guess one particular Ghanaian guy, picked it up also and posted on his twitter page, asking if ladies can actually do what I did by wearing a natural look on a wedding day.
His post also went viral and I guess, that was where bloggers picked it from and assumed that I am a Ghanaian. It was very controversial as I kept receiving all kinds of calls, some condemning me, some applauding, some questioning, I was just pissed at a point.”
Her love story:
We met last year, December 16, 2015 after I was robbed besides Abiola Garden, Lagos at about 9am.
The robbery was a horrible experience; I lost my Blackberry phone, tab and some money. Thankfully, I wasn’t raped but sustained minor injuries. A close friend then volunteered to come help me massage my leg when he heard what happened to me.
When he was coming that morning, he came with his long time friend (who is now my husband). When I first saw them, I almost refused to open the door, because it was quite early and I wasn’t expecting two visitors (one stranger at that time).
Well, I later had to open the door and that was it. After the first visit, he (my husband), came back alone on December 26, to see me and that was how our relationship started.
Few weeks later, he proposed because he was scared that if he wasted more time, another man would take over. (laughs).
We had our court registry in February 2016, barely three months after we met.

Indian police are investigating the parents of a 13-year-old girl who died last week after undertaking a religious fast for 68 days.
Police in southern Hyderabad city told BBC Hindi they want to know if Aradhana Samdariya was forced to fast.
Her parents have insisted she voluntarily fasted as prescribed in Jainism, one of the world's most ancient religions. The case has sparked a debate about the practice of religious fasting in India.
Reports said Aradhana lived for 68 days on boiled water. Two days after she called off her fast last week, she was dead.
Experts believe it is possible for the human body to survive without food for up to two months.
A police spokesperson said a case had been registered against the parents after a child rights organisation filed a complaint.
"The parents - Laxmi Chand and Manshi Samdariya - have been booked under culpable homicide [causing death by negligence] and Juvenile Justice Act [cruelty against minors]," the spokesperson said.
The parents, wealthy jewellers based in Hyderabad, have denied that they forced their daughter to fast.
"She asked permission for upvaas [fast that involves renouncing food]. We asked her to stop after 51 days but she would not give up. Her fast was voluntary. No one forced her," Mr Samdariya said.
But social activists have rejected the family's claim.
"The entire nation should be ashamed that such a practice still exists. Her father's guru advised the family that if she fasted for 68 days, his business would be profitable," activist Achyut Rao told BBC Hindi.
"The girl was made to drink only water from sunrise to sunset. There was no salt or lemon or anything else.

The Ogun State Independent Electoral Commission (OGSIEC)has announced the results of the election held on Saturday into the 20 local government councils and 37 Local Council Development Areas (LCDAs) of the state.
Declaring the results, the commission’s Chairman, Risikat Ogunfemi, said the ruling APC won all the Chairmanship positions in all the 20 local governments and 37 LCDAs.
The party also won 346 councillorship seats out of the 349 wards in the state.
The Unity Party of Nigeria (UPN), however, won two councillorship seats while the Peoples Democratic Party (PDP) won one.
The News Agency of Nigeria (NAN) reports that a total of 17 political parties participated in the poll.
Ogunfemi, who stated that the commission had discharged its duties without fear or favour, adjudged the poll free, fair and credible.
The OGSIEC boss, however, conceded that there was room for improvement on the conduct of council election.
“Election is a process and we can always learn from any shortcomings and improve on subsequent ones. The 2012 local government poll was not as effective as this and so we are sure that the next one will be better than this one,” she said.
Ogunfemi expressed appreciation for the support accorded the commission by the electorate and other stakeholders.
She advised candidates, who might have any complaint concerning the poll, to direct it to the election tribunal which she said would soon be constituted.
The Ogun chapter of the Inter Party Advisory Council (IPAC) is however divided over the conduct of the poll.
The state’s Chairman of IPAC,Alhaji Moshood Adesina, had said on Sunday in Abeokuta that the body carefully reviewed the entire electoral process and was satisfied with the result announced by the electoral body.
But three members of the council— Peoples Democratic Party (PDP), Labour Party (LP) and Unity Party of Nigeria (UPN)– dissociated themselves from the position of the body.
Adesina, however, described the poll as free, fair and credible.
“Guided by reports from our individual party agents across the state and after a careful study and deliberation of same, we hereby declare the poll free, fair and credible,” he said.
He noted that the conduct was transparent and inclusive, adding that a level playing field was provided for all the parties in the contest
Adesina, however, condemned “the few instances where disgruntled elements attempted to snatch ballot boxes or intimidate voters.’’
The chairman commended the electoral body for the “independent manner” in which the poll was conducted.
He also commended the media, security agents and other stakeholders for their various roles in making the poll successful.
But PDP, LP and UPN at separate press conferences called for the cancellation of the poll.
They hinged their arguments on the fact that the poll was characterised by violence and gross electoral irregularities.
The leadership of the South-West Zone of the PDP at a press conference on Sunday described the conduct of the poll as “unacceptable, condemnable and ridiculous.’’
The PDP Secretary in the zone,Bunmi Jenyo, alleged that election materials were not supplied in many polling centres while there were sporadic shootings in many areas to scare voters away.
He also alleged that the process was masterminded to perpetuate the ruling APC in power.
Jenyo, therefore, called for the cancellation of the poll.
Fire on Saturday razed down the library complex of University of Jos, which also houses the faculties of Management and Social Sciences.
The Vice-Chancellor, Prof. Sebastian Maimako, who briefed newsmen on Sunday after inspecting the damage, said the fire started about 6:30PM.
Maimako said that books, unmarked examination scripts and other materials were burnt in the building.
“On the fourth floor, which was completely razed down, we have the departments of Psychology, Political Science, Economics and office of Dean of Management sciences,” he said.
The departments of accounting and business management are also on the floor.
The vice-chancellor expressed shock over the incident and said that the building, which was officially opened in 1997, also had materials from the faculties of Education, Arts and Department of Geology.
The Director of Fire Service in Plateau, Samuel Musa, said that it took six hours to put out the fire.
Musa said that when the fire was reported at 6.40PM, his men immediately rushed to the scene but had to call for reinforcements from other units because of the magnitude of the fire.
The University has postponed ongoing first semester examinations following the incident.
The Registrar, Mr Monday Danjem, said in a statement in Jos on Sunday that the decision was taken “pending an emergency Senate meeting scheduled for Monday, October 10.”
The statement, however urged students and members of the university community to remain calm and go about their normal businesses, noting that the situation had been brought under control.
The Comptroller-General of Customs, Col. Hameed Ali (rtd), has ordered the removal of rice from the import restriction list.
Ali also re-introduced the payment of import duty on all land borders across the federation.
Shedding more light on the new development, the customs spokesman, Mr Wale Adeniyi, in a statement said “Over the years importation has been restricted to the seaports because border authorities have found it difficult to effectively monitor and control importation of rice.
“When the decision to ban it (rice) was taken it was not an effective measure because smuggling of the product thrives with people using different means of conveyance including small trucks, bicycles and even animals – putting them on donkeys and some actually carry it on their heads.
“These new measures will be for customs to recognise their anti-smuggling operations in the border areas and ensure that all those importers through the borders bring their rice through approved routes and pay their extant duty.”
Recently, Hameed Ali said 99 per cent of rice smuggled through the land borders are not fit for human consumption.

Donald Trump issued an apology statement early Saturday morning after video published by the Washington Post showed the Republican presidential nominee having a vulgar discussion about a number of women.
On Friday afternoon, the Post published the 2005 video clip in which Trump told a tale about trying to “f***” a married woman. He can also be heard expressing interest in kissing another woman and saying that when you’re a star, you can do anything with women, including grabbing them “by the p****.”
According to the Post, the video shows Trump going to the set of the soap opera “Days of Our Lives” with Billy Bush of “Access Hollywood,” and the men’s conversation was captured talking on a “hot microphone.” The clip begins with Trump and Bush on a bus emblazoned with the “Access Hollywood” logo as it rolls onto a studio lot. The Post said the men were on the “Days of Our Lives” set to film a segment about Trump making a cameo on the soap opera. The clip begins with the pair discussing an unnamed woman Bush described as “beautiful.”
“I moved on her actually, you know. She was down in Palm Beach. I moved on her and I failed. I’ll admit it. I did try and f*** her. She was married,” Trump said. “I moved on her very heavily,” he added.
Trump went on to describe his courtship of the woman.
“I took her out furniture shopping. She wanted to get some furniture. I said, ‘I’ll show you where they have some nice furniture.’ I moved on her like a b****, but I couldn’t get there, and she was married,” Trump said.
Trump said he ran into the woman some time after his attempt to woo her and found that she looked quite different and had gotten “big phony tits.”
The Washington Post reported that the video was filmed “several months” after Trump married his third wife, Melania.
After Trump described his second meeting with the unnamed woman, Bush interjected to exclaim that he saw a woman who was “hot as s***” and wearing “purple.”
“Whoa!” Trump shouted.
“Yes! The Donald has scored!” Bush yelled.
Before getting off the bus, Trump prepared to meet the woman.
“I better use some Tic Tacs just in case I start kissing her. You know, I’m automatically attracted to beautiful… I just start kissing them. It’s like a magnet. Just kiss. I don’t even wait. And when you’re a star, they let you do it. You can do anything, grab them by the p****,” Trump said.
Bush goes on to compliment the woman’s “good legs.” The pair then disembarked and were greeted by actress Arianne Zucker, who wore purple and was there to escort them onto the set.
“How about a little hug for The Donald? He just got off the bus,” Bush said to Zucker.
Zucker gave Trump a hug and he leaned in to kiss her on the cheek.
“Melania said this was OK,” Trump said.
Zucker did not immediately respond to a request for comment from Yahoo News.

Shortly after the Post’s article about the clip was published, Trump released a initial statement in which he described the discussion with Bush as “locker-room banter.”
“This was locker-room banter, a private conversation that took place many years ago. Bill Clinton has said far worse to me on the golf course — not even close. I apologize if anyone was offended,” Trump said.
Republican National Committee Chairman Reince Priebus released a statement of his own condemning Trump’s remarks.
“No woman should ever be described in these terms or talked about in this manner. Ever,” Priebus said.
Priebus has been a staunch ally of Trump since the end of the Republican primaries and has been involved in prep sessions with Trump for the second presidential debate on Sunday. The RNC has worked closely with the Trump campaign, with committee staff running much of the voter outreach operation.
House Speaker Paul Ryan, who was set to appear Saturday with Trump at a Wisconsin festival, released a statement saying that he was repulsed by Trump’s comments and that Trump would no longer be attending the event.
“I am sickened by what I heard today. Women are to be championed and revered, not objectified. I hope Mr. Trump treats this situation with the seriousness it deserves and works to demonstrate to the country that he has greater respect for women than this clip suggests,” Ryan said.
Trump then announced that his vice presidential pick, Indiana Gov. Mike Pence, would attend the Wisconsin festival. “I will be spending the day in New York in debate prep,” the nominee said in a statement that did not acknowledge the firestorm.

Billy Bush also released a statement, saying he was “very sorry” about the comments he made on the video.
“Obviously, I’m embarrassed and ashamed. It’s no excuse, but this happened 11 years ago — I was younger, less mature, and acted foolishly in playing along. I’m very sorry,” Bush said.
Bush’s Twitter page was taken down on Friday afternoon. Bush left “Access Hollywood” earlier this year to join NBC’s “Today” show. NBC did not respond to a request for comment from Yahoo News.
Trump’s Democratic rival, Hillary Clinton, and her campaign have attempted to make his comments about women a major issue in the election. In September, the Clinton campaign released an ad focusing on Trump’s history of making insulting comments about women based on their appearance. The Clinton campaign took to Twitter shortly after the article about the video was published and called it “horrific.”

The Minister of Power, Works and Housing, Babatunde Fashola while speaking to State house correspondents after the Federal Executive Council meeting at the state house Abuja, yesterday, said that the Federal government will not embark on the award and construction of any new road project until existing road projects from the last administration have all been completed.
Fashola said the last administration awarded 206 road contracts worth about N2 tillion which have not been paid for.
He said that roads that are of great economic value such as the Lagos-Ibadan expressway where important items such as Fuel or Food are to be transported to all parts of the country, are of topmost importance to the government.
He stated:
“What we have done was first to say that we would not award any new road contract. We would deal with the over 206 roads that have been awarded but not funded for over three years.”

Ogun State Governor, Senator Ibikunle Amosun, has rewarded Mrs. Lateefat Omolola Tijani, a Paralympics Silver Medalist from Ogun State, with a cash prize of N1m while her coach, Mrs. Kemi Oyebola, was given a cash prize of N500,000.
In addition to the cash prize, the governor also promised to provide the Paralympian with training kits of her choice that could aid her preparation for the next Paralympic games.
Governor Amosun also charged the Paralympian to ensure that she wins a Gold medal at the next Paralympics.
The governor stated this, on Wednesday, when Mrs. Tijani and her coach, Mrs. Kemi Oyebola, came to present the Silver medal she won in the 45kg weightlifting category of the just concluded Paralympics game in Rio De Janeiro, Brazil, to the governor at his Oke-Mosan, Abeokuta office.
While congratulating the Silver medalist for the feat, Governor Amosun urged her not to relent in her quest for excellence.
The governor also seized the occasion to appreciate the coach, family and all those who supported Mrs. Tijani to achieve this laudable feat.
Responding, Mrs. Tijani thanked the governor for what she described as his “kind gesture and support for sports.” She added that with the governor’s support, “I can assure you that I am going for the Gold medal at the next Olympics.”
A 19-year-old employee, John Edward , was on Tuesday arraigned in Lagos for beating up his employer over delay in the payment of salary.
The accused, whose address was not stated in court, is facing a four-count charge bordering on assault, conspiracy and malicious damage before an Ikeja Magistrates’ Court. The Prosecutor, Mr Ishola Samuel, told the court that the accused committed the offences onSept. 1 at Olusoji Idowu St. Ilupeju, Lagos.
Samuel said the accused conspired with others still at large and assaulted their employer, Solomon David, over delay in the payment of their salaries. “The accused used dangerous weapons such as iron rod and stick to inflict injuries on the complainant,’’ the prosecutor said.
According to him, the accused and his collaborators also destroyed a telephone handset worth N7,000 and tore their employer’s shirt, valued at N10, 000. Samuel said that the offences contravened Sections 410, 171 and 337 of the Criminal Law of Lagos State, 2011.
The accused pleaded not guilty.
The Magistrate, Miss A .R Onilogbo, granted the accused N50,000 bail with two sureties in like sum. The case was adjourned to Nov. 1, for hearing.
